I agree to the following Terms and Conditions for the Personal Finance Festival (Hong Kong) 2023 (“Event”). These Terms and Conditions, together with any terms contained in the relevant completed online registration form (the “Registration Form”), and any other terms and conditions set out at the time of purchase and elsewhere on the Event website (MoneyHero Personal Finance Festival 2023), together form the agreement (the “Agreement”) between MONEYHERO GLOBAL LIMITED, the organiser of this Event (“Company”, “we”, or “us”) and you, the purchaser of an All Access ticket for the Event as detailed in the Registration Form (“You”), in respect of the Event for which You have purchased a ticket.
By submitting your details and purchasing the ticket on the Eventbrite website, You agree to be bound by the Agreement. Certain capitalised words and expressions used in the Agreement have defined meanings as set out below.
a. Entry and Access to the Event
a. Your registration entitles only You, the individual detailed on the Registration Form, to enter and access the Event.
b. By entering the Event you acknowledge and agree to the MoneyHero Website Terms and Conditions and MoneyHero Privacy Policy, and to comply with all laws and regulations applicable to your participation in this Event.
c. Company expressly reserves the right to refuse You entry to, or to remove You from, the Event at any point if Your actions are contrary to the Agreement, or Your conduct at the Event, in the reasonable opinion of Company, is unacceptable.
d. Unless otherwise stated on the Registration Form, entry to the Event is permitted to minors (i.e. persons under the age of 18) under the supervision of a parent or legal guardian who agrees to be bound by this Agreement. We reserve the right to terminate or refuse your registration or refuse to permit access to the Event if it is discovered or brought to our notice that you are a minor attending without supervision of a parent or legal guardian.
e. The Event may include discussion groups, meeting rooms and other forums (“Interactive Areas”) enabling interaction between You, Event exhibitors, Event speakers and other Event attendees. Company does not control and is responsible for information and views expressed, presented, distributed, or made available by the Event exhibitors, Event speakers, and Event attendees (“Information”). Company is under no obligation to monitor the Interactive Areas or the Information. Company cannot guarantee the veracity, accuracy and/or appropriateness of any such Information. Any reliance upon the Information is at your own risk.
f. Company shall not be held liable for any violation of intellectual property rights in content or materials made available via the Event by Event exhibitors, Event speakers, or Event attendees.
g. Company does not control and is not responsible for any materials, gifts, prizes, goods, or services offered, distributed or made available by the Event exhibitors, Event speakers, and Event attendees, and makes no warranty or representations in respect of the same.
h. Company reserves the right to replace any promised reward, item, goodie bag, or gift (“Gift”) with any item(s) of similar value as promised on the Event website. Company makes no warranties or representations as to the quality or fitness of the Gift
i. By accessing and participating in the Event, You acknowledge and agree that Company may record, film, live stream, photograph, or capture your likeness and use, publish, distribute and/or disseminate such media without any further approval from You or paying any compensation to You except where prohibited by law.
2. Your Obligations
During the Event, You agree:
a. to behave in a proper, respectful and appropriate manner and not to behave in any way that risks bringing Company or the Event into disrepute;
b. to comply with all applicable laws and regulations, including the House Rules of the Event venue, as well as any additional terms and conditions reasonably imposed by the Event venue;
c. not to undertake any canvassing, marketing, demonstration, objectionable behaviour, or any other disruptive or unauthorised activity which may disrupt the Event;
d. not to make any video or audio recordings or live streams of any part of the Event for the purposes of marketing, promotion, or any business or commercial purpose; and
e. to comply with the reasonable instructions of any Event staff during the Event. Failure to comply with any of these obligations may lead to Your removal from the Event.
3. Company’s Obligations
Company shall organise the Event using reasonable skill and care, and will permit You to enter the Event on and subject to the terms of the Agreement.
4. Cancellation, Postponement or Change of Event Venue by Company
a. Company reserves the right to cancel, change the date of, or relocate the Event at any time prior to starting date of the Event.
b. If Company postpones, changes the date of or relocates the Event, You shall be entitled to enter the rearranged Event in accordance with the Agreement, and shall not be entitled to a refund of the amount you paid for the Event ticket (“Paid Ticket Price”).
d. If Company cancels the Event, Company will issue to You a non-transferable, non-assignable credit note for the Paid Ticket Price, which may be redeemed against any future Company event, service or product for a period of 12 months from the date of issue. No refunds will be issued.
d. If Company cancels the Event due to a circumstances beyond Company’s control including fire, flood, failure of utility service(s), widespread disease or other public health emergency (including pandemic or epidemic), the outbreak or declaration of war, act of terrorism, or government orders or action (“Force Majeure”), Company in its sole discretion will reschedule the Event or issue You a credit note as set out in this clause 4. Company accepts no liability and will not be liable for any compensation where the performance of its obligations under this Agreement is affected by Force Majeure.
5. Privacy and Your Personal Information
a. To provide you with access to and services in relation to this Event, Company will collect, store, process, use and/or transfer the personal information you provide to us under this Agreement and/or at the Event in accordance with Company’s Privacy Policy (available at MoneyHero Privacy Policy).
b. Company may use and/or share your personal information with third parties, including but not limited to Company’s Event manager, affiliates, agents, contractors, service providers, certain Event exhibitors and speakers (with your confirmation), other Event attendees, prize suppliers and regulatory authorities for the purposes of organising, administering, conducting and promoting this Event. Company shall not be liable for any third party’s misuse of any of Your personal information as a result of Your participation in this Event.
c. During the Event, You may choose to share your contact information from your Event registration with the Event exhibitors you select for the purposes of receiving marketing and/or promotional materials from those exhibitor(s). Company shall not be held responsible for any misuse of such contact information which you have shared with Event exhibitors.
d. Company will not engage in direct marketing without your express consent. If, after giving your consent, you wish to opt out of receiving Company’s direct marketing communications, please contact Company at support@moneyhero.com.hk.
6. Disclaimers and Limitation of Liability
a. Company gives no warranties in respect of any aspect of this Event or any materials related thereto or offered at this Event and, to the fullest extent possible under the laws governing the Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. This Event is provided on an “as-is” basis. The views, opinions, and positions expressed by the Event speakers, Event attendees, or Event exhibitors at this Event are theirs alone and do not necessarily reflect the views, opinions, or positions of Company the Event Platform or any employee thereof. Company makes no representations as to accuracy, completeness, timeliness, suitability, or validity of any information presented by Event speakers, Event attendees, or Event exhibitors. Company does not endorse, and expressly disclaims all liability relating to, any of the products or services provided by Event speakers, Event attendees, or Event exhibitors.
b. Company expressly disclaims all liability relating to any injury, loss or damage suffered by You in relation to the Event, whether caused by the action or omission of Company, its affiliates or representatives Company disclaims any duty of care to You or any other Event attendee, and makes no warranties or representations as to the safety and security of the Event. The foregoing shall apply in all circumstances, except where limited by law.
c. Nothing in this Agreement shall limit or exclude either party’s liability for: (i) death or personal injury; (ii) fraud or fraudulent misrepresentation; or (iii) breach of any other liability which cannot be limited or excluded by applicable law. Subject to this clause, neither Company nor any of its affiliates shall be liable, whether based on a claim in contract, tort (including negligence), breach of statutory duty or otherwise arising out of or in relation to the Agreement, for any indirect or consequential losses.
d. The total aggregate liability of Company to You, whether based on an action or claim in contract, tort (including negligence), breach of statutory duty or otherwise arising out of, or in relation to this Agreement shall not exceed the total amount paid or payable by You under this Agreement to attend the Event.
7. Governing law and jurisdiction
The Agreement shall be governed by and construed in accordance with the laws of Hong Kong SAR. The parties agree that, subject as provided below, courts of Hong Kong SAR shall have exclusive jurisdiction over any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Agreement or its subject matter or formation.
You acknowledge and agree:
- that any personal information that you provide or share with us in connection with the Event may be used for the purposes of the Event and for any other specific reasons outlined above; and
- that you consent to the collection, processing and sharing of your Personal Data by Company and its affiliates in accordance with each of our privacy policies which you can find at MoneyHero Privacy Policy and Eventbrite Privacy Policy respectively.
- that in line with the MoneyHero Privacy Policy, you acknowledge that your Personal Data may be shared with Authorized Persons who may be based outside of Hong Kong for the Permitted Purposes (each as defined in the Privacy Policy).
